Terms of sale

This English version is provided for convenience. The French version prevails.

1. Seller

The products are sold by Tomy Malherbe, sole proprietor (micro-entrepreneur), SIRET 107 282 808 00016, 24 Rue Paul Gauguin, 76290 Montivilliers, France. Full contact details are given in the legal notice.

2. Products

The products offered for sale are those presented in the store at the time of your order, with their main characteristics. Photographs are for illustration purposes.

3. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (CGI). Delivery costs, shown before you confirm your order, are added to the price of the products. In France: €3.90 for orders under €40, free from €40. In the other European Union countries: €5.90 for orders under €60, free from €60.

4. Ordering

You select the products, check the contents of your cart, enter your details and confirm payment. The order is concluded once the payment is accepted. You then receive a confirmation by e-mail.

5. Payment

Payment is due at the time of the order. It is processed by Shopify Payments, which ensures the security of transactions. The available payment methods are those displayed at checkout.

6. Delivery

We deliver to France and to the other countries of the European Union. The estimated delivery time, counted from the confirmation of your order, is 5 to 10 working days in France and 7 to 14 working days in the other European Union countries. A tracking number is sent to you by e-mail as soon as your order ships. If the product is not delivered within the stated time, you can write to us so that we look for a solution; if it has not been delivered within 30 days of the order, you may terminate the contract under the conditions set out in the French Consumer Code. On receipt, check the condition of the parcel and report any anomaly. See also the shipping policy.

7. Right of withdrawal

You have 14 days from receipt to withdraw, without giving a reason. The procedure is detailed in the refund policy.

8. Legal guarantees

The seller is bound by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), valid for 2 years from delivery of the goods, and by the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). For the guarantee of conformity, you do not have to prove that the defect existed during the 24 months following delivery of a new good.

10. Complaints and mediation

11. Governing law

These terms are governed by French law. In the event of a dispute, the competent courts are determined in accordance with the rules applicable to consumers.
